These terms govern your use of emergefinancialsolutions.com and the services provided by Emerge Financial Solutions ("Emerge," "we," "us"). By using the site or submitting a request, you agree to them.
What we are — and aren't
Emerge is a marketplace. We collect information about your situation, review it with you, and connect you with participating lenders and debt resolution providers. We are not a lender, a creditor, a law firm, a credit repair organization, or a debt settlement company. We do not make loans, make credit decisions, negotiate with creditors, or provide legal, tax, or accounting advice.
No guarantee of results
Submitting a request does not guarantee that you will qualify for any loan or program. Loan approval, amounts, rates, and terms are determined solely by the lender. Debt resolution program availability, terms, and outcomes are determined by the provider and vary by state and individual circumstances. Any figures discussed during a review are estimates, not offers or commitments.
Important information about debt resolution programs
If you are connected with a debt resolution provider, understand that: enrolling may negatively affect your credit; creditors may continue collection activity and may pursue legal action; forgiven debt may be treated as taxable income; results are not guaranteed; and programs are not available in all states. Fees for debt resolution services are charged by the provider only after a settlement is reached and a payment is made toward it. Review the provider's agreement carefully before enrolling.
Your responsibilities
- Provide accurate and complete information, and update it if it changes.
- Use the site only for lawful, personal purposes.
- Do not attempt to interfere with, scrape, reverse-engineer, or disrupt the site.
- You must be at least 18 years old and a U.S. resident to submit a request.
Communications
By submitting a request and providing consent, you agree to be contacted as described in the consent language on our forms and in our SMS Terms. Calls may be recorded or monitored. You can withdraw consent at any time as described in our Privacy Policy.
Third parties
Participating partners are independent companies. Emerge is not responsible for their products, services, decisions, or practices. Your relationship with a partner is governed by that partner's own terms and agreements. Our Participating Partners page lists the companies we currently work with.
Intellectual property
The site, its content, logos, and design are owned by Emerge or its licensors and may not be copied or used without permission.
Disclaimer of warranties
The site and our services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose. Information on the site is for general educational purposes and is not financial, legal, or tax advice.
Limitation of liability
To the fullest extent permitted by law, Emerge and its owners, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site or services, or from any decision you make based on information provided. Our total liability for any claim will not exceed one hundred dollars ($100).
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Orange County, California.
Changes
We may update these terms from time to time. The "last updated" date reflects the current version. Continued use after changes means you accept them.
